TERMS OF USE [2025]
EDEN TODAY APP Terms of Use between EDEN TODAY [PTY] LTD and the user of this app ("You" or "Your").
The EDEN TODAY APP Terms of Use set out below (Agreement) govern Your use of the EDEN TODAY APP and form a binding agreement between EDEN TODAY [PTY] LTD and You in relation to Your use of the EDEN TODAY APP.
Please read the Agreement carefully before using the EDEN TODAY APP. If You have any questions, please contact us at [email protected] prior to agreeing. By using the EDEN TODAY APP You acknowledge and agree that You have had an opportunity to read and understand the Agreement and agree to be bound by it.
1. Using the EDEN TODAY APP’s general requirements
• EDEN TODAY [PTY] LTD will make the EDEN TODAY APP available to You on the terms and conditions of this Agreement.
• You may use the EDEN TODAY APP in accordance with this Agreement.
• EDEN TODAY [PTY] LTD takes the accuracy of its Database very seriously. If You see any material on the EDEN TODAY APP which:
- infringes any law, regulation, standard or relevant industry code;
- breaches the requirements of this Agreement;
- is incorrect,

• The EDEN TODAY APP contains content created by third parties, other information obtained from public sources and links to other websites (such content and websites together, Third Party Content).
• Automated access to the EDEN TODAY APP by or on behalf of internet search engines is permitted.
• You must not:
- access the EDEN TODAY APP other than through the normal EDEN TODAY APP interface;
- access the EDEN TODAY APP through any automated means (including, without limitation, through the use of scripts or webcrawlers);
- infringe the intellectual property rights of others;
- impersonate or falsely state or misrepresent an affiliation with any person or organisation;
- use the EDEN TODAY APP or any information contained on the EDEN TODAY APP in connection with any surveys, contests, pyramid schemes, chain letters, junk email, spamming or any similar activity;
- violate any applicable law, regulation, standard or relevant industry code;
- sell, resell, reproduce, duplicate, trade or exploit for any commercial purpose any portion of, use of, access to or data on the EDEN TODAY APP which does not form part of Your Business Profile;
• You acknowledge and agree that EDEN TODAY [PTY] LTD retains complete editorial control over the EDEN TODAY APP and that EDEN TODAY [PTY] LTD may, in its sole discretion and without notice to You:
- reject, remove, delete or amend any material contained on the EDEN TODAY APP or in the Database at any time, including (without limitation) any material contained in any Business Listing;
- reject, refuse, remove, delete or amend any Content at any time;
- position Content and/or any Business Profile as it sees fit;
• EDEN TODAY [PTY] LTD may terminate this Agreement, remove Your Business Listing or any Content posted by You and/or refuse You access to the EDEN TODAY APP if You have breached, or we consider that You will breach, this Agreement or for any other reason that EDEN TODAY [PTY] LTD, in its sole discretion, sees fit.
• You acknowledge and agree that all Business Listings on the EDEN TODAY APP have been paid for by a business and will therefore be displayed as a Business Listings in the relevant search results.
2. Business Listings and Events
• You may use the EDEN TODAY APP to add, amend and/or update a Business Listing or an Event, solely on the terms and conditions of this Agreement.
• All Content must:
- be complete and accurate;
- be supplied in the manner and format specified on the EDEN TODAY APP;
- not be of a nature likely to bring the EDEN TODAY APP into disrepute; and
- comply with all laws, regulations, standards and relevant industry codes.
• You must not:
- Use the EDEN TODAY APP to post Content for a business that is not located in South Africa;
- use the EDEN TODAY APP to add or amend a Business Listing where You do not have the express authorisation of that business to do so;
- upload, post, transmit, publish or otherwise make available any Accessible Content that You do not have a right to make available under any law, regulation, rule or code or under contractual or other legal relationships;
- upload, post, transmit, publish or otherwise make available any false, misleading, inappropriate, profane, defamatory, abusive, threatening, obscene, indecent or unlawful Content or Accessible Content;
- infringe the intellectual property rights of others; or
- breach a law including, without limitation, any law that restricts advertising of a profession.
• If any of the information in the Business Listing for Your business changes, becomes out of date, or no longer complies with this Agreement, You must:
- immediately amend Your Business Listing so that it complies with this Agreement; and/or
- immediately notify us at [email protected]
• You acknowledge and agree that by posting Content onto the EDEN TODAY APP You consent to being contacted (on an ongoing basis) via any of the contact details contained in that Content, including (without limitation) where such contact involves receiving information about products or services which we think may interest You from the EDEN TODAY APP.
3. Intellectual Property Rights
• The EDEN TODAY APP and the Database is owned and operated by EDEN TODAY [PTY] LTD. You acknowledge and agree that all intellectual property rights comprised in or relating to the EDEN TODAY APP and the Database belong to EDEN TODAY [PTY] LTD or our licensors, and that nothing in this Agreement constitutes a transfer of any intellectual property rights.
• You may download and view content and/or print a copy of material on the EDEN TODAY APP for Your own use only, provided You do not:
- modify the content (including, without limitation, any copyright notice) in any way;
- make the content public; or
- use the content in a manner or for a purpose prohibited by this Agreement.
• You must not do anything which breaches or otherwise interferes with EDEN TODAY [PTY] LTD's intellectual property rights. Except as expressly permitted by this Agreement or by law, You may not reproduce any content appearing on the EDEN TODAY APP without our written permission and, if required, payment of a specified fee. Requests to reproduce any content may be made via email at [email protected].
• We may publish and communicate to the public any Content. By posting Content onto the EDEN TODAY APP, You grant us a perpetual, royalty-free, non-exclusive, irrevocable, worldwide and transferable licence to:
- reproduce, modify, add to, use, copy, publish, communicate and adapt the Content for any purpose and in any manner anywhere in the world, including (without limitation) on the EDEN TODAY APP and as part of the Database;
• You must waive, and must ensure that all other persons waive, absolutely and irrevocably all moral rights in relation to any Content. For the purposes of this clause, a moral right may be waived by consenting to any act or omission which would otherwise constitute an infringement of that moral right.
• For the avoidance of doubt, You acknowledge and agree that:
- the License includes a right for us to make the Content available to the public via any website or as part of any services or products in any jurisdiction;
- we will allow the EDEN TODAY APP users to search Content You have posted; and
- You will do everything necessary (including without limitation, on request, execution of any documents) to give EDEN TODAY [PTY] LTD the full benefit of the licenses, waivers and consents.
• The Licence will survive any termination of this Agreement.
• Your use of some Third Party Content (including, without limitation, third party websites linked to the EDEN TODAY APP) may be subject to a third party's terms and conditions of use. Nothing in this Agreement (or otherwise on the EDEN TODAY APP) constitutes a licence or right for You to use such content.
4. Privacy
• Any personal information collected by EDEN TODAY [PTY] LTD will be dealt with in accordance with EDEN TODAY APP Privacy Policy.
• You consent (and must procure that any relevant third party consents) to the use of any personal information collected in relation to You (including, without limitation, any personal information contained in Content) in accordance with the EDEN TODAY APP’s Privacy Policy. If You include any personal information about any person in any Content, You must:
- provide that person with a copy of the EDEN TODAY APP’s Privacy Policy prior to providing us with that personal information; and
- where possible, have that person provide us with that personal information directly.
5. Warranties
You represent and warrant to EDEN TODAY [PTY] LTD that:
• You are fully authorised to publish and to authorise EDEN TODAY [PTY] LTD to publish all Content (including, without limitation, having full authorisation from any business whose Business Profile You add, amend or update);
• publication of Accessible Content in accordance with this Agreement will not, at any time, infringe any intellectual property right, moral right or any right of confidence or other right of any person;
• You have the ability to grant the Licence;
• all Accessible Content will, at all times, comply with all applicable laws, regulations and relevant industry codes;
• all products and services advertised in Accessible Content will match the advertised description, and be available in the manner, at the price and for the time period advertised;
• the Accessible Content does not, and will not at any time, infringe any intellectual property right, moral right or any right of confidence or other right of any person;
• You have obtained the consent of all individuals whose personal information is included in the Content to:
- the collection of that personal information by EDEN TODAY [PTY] LTD; and
- the use and disclosure of that personal information in accordance with the EDEN TODAY APP’s Privacy Policy;
• all Accessible Content will be current and accurate, and will not mislead or deceive end users of the EDEN TODAY APP; and
• each website represented by any URL shown or embedded in the Business Listing or Event for Your business:
- is controlled and operated by Your business or its independent contractor;
- will be functional and accessible at all times; and
- is suitable in all respects, including (without limitation) subject matter, to be linked to the EDEN TODAY APP.
6. Liability
• The EDEN TODAY APP is provided "as is", and You acknowledge and agree that EDEN TODAY [PTY] LTD has no control over Third Party Content and that Your use of the EDEN TODAY APP (including, without limitation, all material obtained from or linked to the EDEN TODAY APP) is at Your sole risk. Nothing on the EDEN TODAY APP constitutes the giving of financial or other advice. You should obtain qualified professional advice before acting based on any information on the EDEN TODAY APP.
• To the full extent permitted by law, EDEN TODAY [PTY] LTD excludes all liability to You for any damages or loss (including without limitation, loss of profits, indirect or consequential loss) however caused (including, without limitation, damage or loss arising in contract, tort (including, without limitation, negligence), statute or otherwise) suffered by You in connection with:
- Your use of, or reliance on, the EDEN TODAY APP (or any information contained on or linked to the EDEN TODAY APP);
- any dealings You have with any business displayed on the EDEN TODAY APP.
• Certain legislation may imply warranties or conditions or impose obligations which cannot be excluded, restricted or modified except to a limited extent. This Agreement must be read subject to those statutory provisions. If those statutory provisions apply, notwithstanding any other provision in this Agreement, to the extent to which EDEN TODAY [PTY] LTD is entitled to do so, EDEN TODAY [PTY] LTD limits its liability in respect of any claim under those provisions to:
- the supply of the services again; or
- the payment of the cost of having the services supplied again.
• You hereby indemnify and hold harmless EDEN TODAY [PTY] LTD and its employees from and against any liability, loss, damage, costs and expense (including, without limitation, legal expenses on a full indemnity basis) and penalties incurred or suffered by any of them arising out of:
- Your breach of this Agreement, including (without limitation) a warranty;
- any act of fraud or wilful misconduct by or on behalf of You; and
- the publication or use of, or any act or omission in relation to, the Accessible Content including, without limitation, claims brought by any third party relating to defamation, negligent misstatement, injurious falsehood, contempt of court, rights of publicity and/or privacy, copyright infringement, trade mark infringement, other intellectual property infringement, passing off, misleading or deceptive conduct and any failure to comply with or fulfil any representations, warranties or agreements.
7. General
• We may provide You with notices by email, or by posting content on the EDEN TODAY APP or website.
• You should carefully read and agree to this Agreement each time You use the EDEN TODAY APP. Whilst EDEN TODAY [PTY] LTD hopes not to have to alter this Agreement, it is possible that changes will be required from time to time. By using the EDEN TODAY APP (including, without limitation, by posting any Content) You agree that the then current version of this Agreement will apply to that use.
• EDEN TODAY [PTY] LTD may assign this Agreement provided that the relevant assignee undertakes to perform all of EDEN TODAY [PTY] LTD's obligations herein. Subject to the foregoing, neither party may assign this Agreement in whole or in part.
• The indemnities in this Agreement are:
- continuing obligations of the parties, separate and independent from their other obligations and survive termination of this Agreement; and
- absolute and unconditional and unaffected by anything that might have the effect or prejudicing, releasing, discharging or affecting in any other way the liability of the party giving the indemnity.
8. Acceptable Use Policy
The EDEN TODAY APP is in line with Google Play Store, Apple App Store and IAPHUB’s acceptable use policy.
9. Data Removal
Registered Users can remove the profile signing into the account. We provide a "Delete Account" button on the settings page. By clicking the user's data will be removed across the entire EDEN TODAY APP including Reviews, Photos and Published Questions. The user can request data removal via email to [email protected].
A Business Listing or Event can be removed if you hold login credentials by signing into the account. We provide a "Delete Account or Listing" button. By clicking the user's data and the business listing will be removed across the entire EDEN TODAY APP.
10. Definitions
In this Agreement:
Content means all content posted by You onto the EDEN TODAY APP including, without limitation, all text, graphics, icons, photographs and URLs.
Accessible Content means all Content and all similar content on sites to which URLs contained in Your Content are linked.
Business Listing or Event means a business profile in the Database. A Business Profile may contain information about the profiled business, for example, contact details.
Database means the national database of Business Profiles which is collected by EDEN TODAY [PTY] LTD and made accessible to the public via the online business directory on the EDEN TODAY APP.

TERMS OF SERVICE [2025]
Pursuant to these Terms of Service, EDEN TODAY [PTY] LTD agrees to provide you ("Account Holder") access to the EDEN TODAY [PTY] LTD service (the "Service") through the EDEN TODAY APP. These Terms of Service, together with EDEN TODAY [PTY] LTD's Privacy Policy, are referred to as this "Agreement". By using the Service, Account Holder agrees to, and agrees to be bound by, all the terms and conditions of this Agreement.

1. Terms of Payment
Account Holder shall be solely responsible for the payment of and shall pay when due and indemnify EDEN TODAY [PTY] LTD against, all applicable taxes, and payments to EDEN TODAY [PTY] LTD under this Agreement. Account Holder shall pay EDEN TODAY [PTY] LTD the fees set forth in the applicable subscription agreement or order form on the EDEN TODAY APP.
2. Term; Termination
• The term of this Agreement shall be as set forth in an Order Form between the parties. Unless provided in the Order Form, the term of this Agreement shall automatically renew (the "Automatic Renewal") on the first day following the end of the current subscription term (the "Renewal Date"). Account Holder may cancel such Automatic Renewal by terminating the subscription and this Agreement.
• EDEN TODAY [PTY] LTD may terminate this Agreement in the event the Account Holder breaches this Agreement and fails to cure such breach within 30 days after receiving written notice thereof. In the event of any such termination:
- Account Holder will remain liable for any amount due under this Agreement (adjusted on a pro rata basis, if applicable) and;
- EDEN TODAY [PTY] LTD will destroy all Account Holder Data in its database.
• The Account Holder may terminate this Agreement and its subscription to EDEN TODAY [PTY] LTD.
3. Intellectual Property Ownership and Licenses
• EDEN TODAY [PTY] LTD Ownership Rights
EDEN TODAY [PTY] LTD shall own and retain all right, title, and interest in and to the Service. EDEN TODAY [PTY] LTD hereby grants to Account Holder a worldwide, royalty-free, non-exclusive, revocable, limited license to use the Service during the Term as expressly provided hereunder. Account Holder agrees not to copy, alter, modify, or create derivative works of the EDEN TODAY APP or otherwise use the Service in any way that violates the use restrictions contained in this Agreement. EDEN TODAY [PTY] LTD does not grant to Account Holder any license, express or implied, to the intellectual property of EDEN TODAY [PTY] LTD.
• Login and Hosting Restrictions
The Account Holder acknowledges and agrees that the Account Holder’s login information for the Service (e.g., username and password), including without limitation login information provided to individuals who the Account Holder invites to be administrators or agents on the Account Holder’s account, may be used by only one person, and use of a single login for the Service by multiple people is strictly prohibited. For the avoidance of doubt, the Account Holder agrees that it shall not host the Service, on its own or any third party servers. Notwithstanding anything to the contrary contained herein, the parties agree that if the Account Holder violates the provisions of this Subsection, EDEN TODAY [PTY] LTD shall have the right to terminate this Agreement immediately and without notice.
• EDEN TODAY [PTY] LTD respects the intellectual property of others. It may, in appropriate circumstances and at its discretion, disable and/or terminate the accounts of users who EDEN TODAY [PTY] LTD, in its determination, believes have repeatedly infringed others' rights. If the Account Holder or any of its End Users believes that its work has been copied in a way that constitutes copyright infringement, or its intellectual property rights have been otherwise violated, please provide the following information to EDEN TODAY [PTY] LTD copyright agent via email to [email protected]:
- An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
- A description of the copyrighted work or other intellectual property that the Account Holder claims has been infringed;
- Description of where the material that the Account Holder claims is infringing is located on the app, including a url link;
- Account Holder’s address, telephone number, and email address;
- A statement by the Account Holder that it has a good faith belief that the disputed use is not authorized or consented to by the copyright owner, its agent, or the law; and
- A statement by the Account Holder, made under penalty of perjury, that the above information in the Account Holder’s notice is completely accurate and that the Account Holder is the copyright or intellectual property owner or are authorized to act on the copyright or intellectual property owner's behalf.
4. Representations and Warranties
Each party hereby represents and warrants to the other party that:
• it has the full right, power and authority to enter into this Agreement;
• this Agreement is a valid and binding obligation of such party;
• it has obtained and shall maintain throughout all necessary licenses, authorizations, approvals and consents to enter into and perform its obligations hereunder in compliance with all applicable laws, rules and regulations; and
• it shall comply with all applicable laws, rules and regulations, including applicable privacy and data protection laws.
Account Holder’s further represents and warrants that its business listing hosted on the Service does not infringe the copyright, trademark, or any other intellectual property rights of any third party, and that such data is otherwise in compliance with this Agreement. EDEN TODAY [PTY] LTD reserves the right, in its sole discretion, to delete Account Holder's listings from the EDEN TODAY APP if EDEN TODAY [PTY] LTD has reason to believe the Account Holder’s listing is in violation of this section. EDEN TODAY [PTY] LTD further represents and warrants that the Service does not infringe the copyright, trademark or any other intellectual property rights of any third party.
5. Indemnification
Each party agrees to indemnify and hold the other party and its affiliates and agents harmless from and against any losses, costs, liabilities and expenses, including attorney’s fees, arising out of the breach of the representations, warranties and covenants made by such party herein, or out of such party’s negligence or willful misconduct. Except in the case of EDEN TODAY [PTY] LTD negligence or willful misconduct. Account Holder’s further agrees to indemnify and hold EDEN TODAY [PTY] LTD and its affiliates and agents harmless from and against any losses, costs, liabilities and expenses, including attorney’s fees, arising out of the Account Holder Data. The indemnifying party shall be entitled to assume the defense and control of any matter for which it is required to indemnify the other party hereunder, and the other party agrees to cooperate with the indemnifying party’s defense of such claims; provided, however, that the indemnified party may also participate in such defense with counsel of its choosing, at its sole expense.
6. Disclaimers; No Warranties
UNLESS EXPRESSLY SET FORTH IN THIS AGREEMENT, EDEN TODAY [PTY] LTD MAKES NO WARRANTY, EXPRESS OR IMPLIED, WITH RESPECT TO ANY MATTER, INCLUDING WITHOUT LIMITATION THE SERVICE, AND EXPRESSLY DISCLAIMS THE IMPLIED WARRANTIES OR CONDITIONS OF NONINFRINGEMENT, MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR PURPOSE. EDEN TODAY [PTY] LTD DOES NOT WARRANT THE RESULTS OF USE OF THE SERVICE, AND ACCOUNT HOLDER ASSUMES ALL RISK AND RESPONSIBILITY WITH RESPECT THERETO. ACCOUNT HOLDER SHOULD NOTE THAT IN USING THE SERVICE, SENSITIVE INFORMATION WILL TRAVEL THROUGH THIRD PARTY INFRASTRUCTURES THAT ARE NOT UNDER EDEN TODAY [PTY] LTD'S CONTROL (SUCH AS A THIRD PARTY SERVERS). EDEN TODAY [PTY] LTD MAKES NO WARRANTY WITH RESPECT TO THE SECURITY OF SUCH THIRD PARTY INFRASTRUCTURES.
7. Limitation of Liability and Damages
UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SYSTEM FAILURE OR NETWORK OUTAGE, WILL EITHER PARTY OR ITS AFFILIATES BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, RELIANCE, OR EXEMPLARY DAMAGES INCLUDING, BUT NOT LIMITED TO LOSS OF DATA, LOSS OF BUSINESS, PROFITS OR OTHER LOSS, THAT RESULT FROM THIS AGREEMENT, EVEN IF SUCH PARTY OR ITS AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. EXCEPT FOR THE INDEMNITY OBLIGATIONS SET FORTH HEREIN, IN NO EVENT WILL EITHER PARTY’S OR ITS AFFILIATES TOTAL LIABILITY TO THE OTHER PARTY FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION ARISING OUT OF OR RELATING TO THIS AGREEMENT (WHETHER IN CONTRACT OR TORT, INCLUDING NEGLIGENCE, WARRANTY, OR OTHERWISE) EXCEED THE AGGREGATE FEES DUE BY ACCOUNT HOLDER TO EDEN TODAY [PTY] LTD HEREUNDER DURING THE PRIOR 12 MONTHS.
8. Confidentiality
"Confidential Information" shall mean
• all Account Holder Data; and
• any information generally understood to be confidential in nature or designated as such by either party, but shall not include information that:
- is independently developed by the receiving party without access to the other party's Confidential Information;
- becomes publicly known through no breach of this Agreement by the receiving party;
- has been rightfully received from a third party authorized to make such disclosure;
- has been approved for release in writing by the disclosing party; or
- is required to be disclosed by a legal or governmental authority.
During the term of this Agreement, and for 12 months following termination, neither party will, subject to the license expressly granted herein, use, sell or disclose any Confidential Information of the other party except as specifically contemplated herein. Notwithstanding the foregoing, either party may disclose the other party’s Confidential Information solely as necessary to comply with applicable laws, rules or regulations.
9. Miscellaneous
EDEN TODAY [PTY] LTD reserves the right, at its sole discretion, to modify these Terms of Service, at any time and without prior notice. If EDEN TODAY [PTY] LTD modifies these Terms of Service, we will post the modification on our website or app or provide notice of the modification; provided, however, that unless otherwise mutually agreed by EDEN TODAY [PTY] LTD and the Account Holder in writing, no such modification, discontinuation or termination shall be effective until the Account Holder’s next Renewal Date. Neither party shall assign any of its rights, obligations or licenses hereunder without the prior written consent of the other party; provided, however, that either party may assign this Agreement and its rights and obligations hereunder, to a successor of such party by way of merger, consolidation or acquisition of all or substantially all of the assets or business of such assigning party so long as such successor shall agree to be bound by all of the terms and provisions hereof. EDEN TODAY [PTY] LTD and Account Holders are independent contractors, and neither EDEN TODAY [PTY] LTD nor Account Holders are agent, representative, employer, employee, or partner of the other. EDEN TODAY [PTY] LTD and Account Holders shall each have sole responsibility for all acts and omissions of their respective personnel. This Agreement sets forth the entire agreement between EDEN TODAY [PTY] LTD and all Account Holders. This Agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa, without giving effect to principles of conflicts of law. Any notices to be provided to EDEN TODAY [PTY] LTD under this Agreement shall be sent to EDEN TODAY [PTY] LTD by electronic mail at [email protected] and such notice shall be deemed given upon receipt. Any notices to be provided to Account Holders under this Agreement shall be sent by electronic mail to the last email address that EDEN TODAY [PTY] LTD has on file for the Account Holder at the sole discretion of EDEN TODAY [PTY] LTD. The waiver of any breach or default of this Agreement will not constitute a waiver of any subsequent breach or default and will not act to amend or negate the rights of the waiving party. If any provision contained in this Agreement is determined to be unenforceable in any respect, then such provision will be severed, and the remaining provisions of this Agreement will remain in full force and effect.

PRIVACY POLICY [2025]
This privacy policy applies to all personal information collected by EDEN TODAY [PTY] LTD via the internet.
EDEN TODAY [PTY] LTD recognizes the importance of your privacy, and that you have a right to control how your personal information is collected and used. We know that providing personal information is an act of trust and we take that seriously. Unless you directly give us consent to do otherwise, EDEN TODAY [PTY] LTD will only collect and use your personal information as set out below.
1. Collection of Information

EDEN TODAY [PTY] LTD will not rent, sell, or share information about you with other people or non-affiliated companies. Any other data collected on the app is purely for the purpose of running the app and will not be shared, rented or sold.

Emails sent through the app, enquiries and replies are one-off emails. We will not distribute any email addresses to any third party or associated company of EDEN TODAY [PTY] LTD or use them for anything other than their intended purpose.

CANCELLATIONS, REFUNDS & RETURNS POLICIES
